These Terms form a binding agreement between you (“you” or “User”) and Quiz Please Limited (Hong Kong) (“Company,” “we,” “us,” or “our”). These Terms govern all mobile applications and related online features that we publish under our Google Play developer account (collectively, the “Apps” or the “Services”). By installing, accessing, or using any App, or by tapping “I Agree,” you accept these Terms and our Privacy Policy. If you do not agree, do not use the Apps.
1. Eligibility
The Apps are designed for a general audience and do not contain 18+ content. They are not directed to children under 13 (or under the age of digital consent in your region, e.g., 16 in the EEA). Where required by law, minors may use the Apps only with parental consent and supervision.
2. Licence to Use
Subject to these Terms, we grant you a personal, limited, non‑exclusive, non‑transferable, revocable licence to access, view, download, and use the Apps solely for your personal, non‑commercial entertainment. You must not copy, reverse‑engineer, decompile, modify, distribute, or create derivative works of the Apps; circumvent security or usage limits; use bots/automation; or use the Services for unlawful purposes or to infringe others’ rights.
3. Accounts & Security (if offered)
Some features may require an in‑App account or linking a third‑party account (e.g., Google). Where such a feature is offered, registration is mandatory to access that feature. You are responsible for safeguarding your credentials and for all activity under your account, whether or not authorised by you. Notify us promptly of any unauthorised use at mobile+support@quizplease.com.
4. Purchases, Billing & Refunds
Purchases (including any subscriptions or in‑App items) are processed by Google Play or other authorised payment providers. By purchasing, you agree to their terms. All sales are final except where required by law or Google Play’s refund policies. Subscriptions (if offered) auto‑renew until cancelled in Google Play; cancellation stops future charges but does not refund the current period.
5. Virtual Items & Virtual Currency (if offered)
You receive a limited licence to use any virtual items or in‑App currency within an App; they have no real‑world value, are non‑redeemable, and are not your property. You may not sell, transfer, or trade virtual items/currency except via in‑App functionality expressly permitted by us and only without real‑world consideration. We may manage, regulate, modify, or discontinue virtual items at any time without liability to you.
6. User Content & Community Rules (if offered)
You retain rights in any content you submit (UGC), but you grant us a worldwide, royalty‑free, sublicensable licence to use, host, reproduce, modify, distribute, publicly perform/display, and create derivative works from your UGC to operate and improve the Services. Do not post content that is illegal, infringing, harmful, harassing, hateful, defamatory, obscene, deceptive, or that violates privacy/publicity rights. We may remove UGC and/or suspend access at our discretion.
7. Third‑Party Services, Ads & Links
The Apps may display third‑party content/ads or link to third‑party sites/services. We do not control or endorse them and are not responsible for their content, privacy, or practices. Your use is at your own risk and may be governed by third‑party terms.
8. Updates, Availability & Support
We may release patches/updates and may modify, suspend, limit, or discontinue any App or feature at any time, with or without notice. The Services may occasionally be unavailable due to maintenance, outages, or events beyond our control. Basic support is available via mobile+support@quizplease.com.
9. Data & Privacy
Your data is handled as described in our Privacy Policy. Some features (e.g., analytics, crash reporting, purchases) rely on Google Play Services or other SDKs described in the policy.
10. Disclaimers
THE APPS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR‑FREE OPERATION.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID (IF ANY) TO US FOR THE APP IN THE SIX (6) MONTHS PRECEDING THE CLAIM. Nothing in these Terms affects non‑waivable consumer rights.
12. Termination
We may suspend or terminate access if you violate these Terms or if we discontinue an App. Upon termination, the licence in Section 2 ends; sections that by nature should survive (e.g., 5–11) will survive.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of Hong Kong SAR, without regard to conflict‑of‑laws rules. You agree that courts located in Hong Kong shall have exclusive jurisdiction, except where consumer law gives you the right to bring claims in your place of residence.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated in‑App or on the store listing. Continued use after the effective date means you accept the updated Terms.
